2. What this site is

Neighborly Pest Control operates a free connection service that helps homeowners reach independent local service contractors. We are not a pest control contractor, we do not perform, supervise, schedule, or price any pest control work, and we are not a party to any agreement you enter into with a contractor.

3. Independent contractors

All contractors are independent businesses. They are not employees, agents, partners, or representatives of Neighborly Pest Control. We do not warrant or guarantee any work performed. It is the responsibility of the homeowner to verify that the hired contractor furnishes the necessary license and insurance required for the work being performed, and to evaluate the contractor’s qualifications, pricing, and terms before hiring.

4. Eligibility and your responsibilities

• You must be at least 18 years old and able to enter into a binding contract.
• You agree to provide accurate, current, and complete information.
• You agree to submit only contact details you own or are authorized to provide, and not to submit another person’s information without their permission.
• You agree not to misuse the site, including attempting to disrupt it, scrape it, gain unauthorized access, or use it for any unlawful purpose.

5. Communications consent

If you check the consent box on our form, you agree that Neighborly Pest Control and its independent contractor partners may contact you at the phone number and email address you provided, including by automatic telephone dialing system, prerecorded or artificial voice messages, and SMS text messages. Consent is not a condition of any purchase. Message and data rates may apply. You may revoke consent at any time by replying STOP to a text message or emailing info@neighborlypestcontrol.pro.

6. No guarantee of availability or outcome

We do not guarantee that a contractor will be available in your area, that any contractor will contact you, that any work will be scheduled or completed, or that any particular result will be achieved. Any pricing, scope, warranty, or guarantee is offered solely by the contractor you hire.

7. Intellectual property

The site, including its text, layout, graphics, and logos, is owned by Neighborly Pest Control or its licensors and is protected by intellectual property laws. You may not copy, reproduce, republish, or create derivative works from the site without our prior written permission.

8. Photographs and models

All persons depicted in a photo or video on this site are actors or models and not contractors listed on this site.

9. Disclaimer of warranties

The site is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free, or that any information on the site is accurate or complete.

10. Limitation of liability

To the fullest extent permitted by law, Neighborly Pest Control and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or property, arising out of or related to your use of the site or any interaction with, or work performed by, any contractor. Our total aggregate liability for any claim relating to the site will not exceed one hundred U.S. dollars ($100).

11. Indemnification

You agree to indemnify and hold harmless Neighborly Pest Control and its officers, employees, and affiliates from any claims, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of your use of the site, your violation of these terms, or your dealings with any contractor.

The site may link to third-party websites that we do not control. We are not responsible for their content, policies, or practices.

13. Termination

We may suspend or terminate your access to the site at any time, with or without notice, for any reason, including suspected misuse.

14. Governing law and disputes

These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute arising out of or relating to these terms or the site will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the jurisdiction of those courts. Nothing in this section prevents either party from seeking relief in small claims court.
